Freedom Forum Article: Is Lying Protected by the First Amendment

Highly recommend taking a look at the article written by Kevin Goldberg, First Amendment specialist at the Freedom Forum and a good friend of the firm, which describes when lying is and is not protected by the First Amendment: Is Lying Protected by the First Amendment?.

And how does the First Amendment apply to private businesses? Well, generally speaking private businesses can set their own rules about what messages they decide to support. Many people do not realize that the First Amendment only protects people in the United States against government actions that infringe on our rights to religion, speech, press, assembly and petition, not necessarily those of private businesses. However, business owners should still be aware that they must comply with, among other things, Title VII of the Civil Rights Act of 1964, which prohibits certain kinds of discrimination against employees.
